EB-3 Visas in Greenville
Direct Attorney Guidance for Greenville EB-3 Green Cards
An EB-3 visa can provide a path to lawful permanent residence for a qualified foreign worker with a permanent, full-time job offer from a United States employer. Colón Law Firm guides Greenville employers and foreign workers through each stage of the process.
We handle immigration matters exclusively. Clients work directly with our immigration lawyers and receive individualized guidance in English, Spanish, or Portuguese. We explain employers’ filing responsibilities and assess whether workers’ education, training, or experience meets the requirements of an EB-3 category.

Who Qualifies for an EB-3 Visa?
EB-3 is the third-preference immigrant visa category for skilled workers, professionals, and other workers. Each classification has distinct requirements, but all require a permanent, full-time job offer from a U.S. employer.
The job’s requirements and the worker’s qualifications must align. The position can’t be temporary or seasonal, and the employer must sponsor the worker through the required immigration filings.
The three EB-3 classifications are:
- Skilled workers: The position requires at least two years of training or experience. Relevant education completed after secondary school may count as training.
- Professionals: The worker holds at least a United States bachelor’s degree or a foreign equivalent, and the offered position requires a bachelor’s degree.
- Other workers: The position requires less than two years of relevant preparation but remains permanent and nonseasonal.
Classification depends on more than selecting the category that appears closest. The employer’s job requirements, the worker’s credentials, and the supporting records must align. We review these elements together before proceeding with government filings.
Labor Certification Requirements for Greenville EB-3 Cases
Most EB-3 cases require the sponsoring employer to obtain labor certification from the United States Department of Labor before filing an immigrant petition. This requirement also applies to many EB-2 cases.
The Department of Labor considers whether qualified U.S. workers are available for the position and whether employing a foreign worker would adversely affect wages and working conditions in similar jobs. Because this assessment focuses on the job, the position’s requirements and employment terms are central to the filing.
Most cases use Form ETA-9089, the application for permanent employment certification. Schedule A occupations are an exception to the usual Department of Labor approval process. Whether that exception applies depends on the occupation and the proposed employment.
How the EB-3 Process Works
An EB-3 matter involves several connected steps rather than a single visa application. We explain what information is needed, guide the employer and worker through each stage, and maintain ongoing communication as the case progresses.
Initial Case Review
We first review the offered position and the worker’s qualifications. We determine whether the job is permanent and full time, identify the appropriate EB-3 classification, and assess how the worker’s education and background correspond to the position.
Department of Labor Filing
When certification is required, the employer completes the Department of Labor process before filing the immigrant petition. The application must accurately reflect the sponsored job and its requirements. We explain how this stage fits into the broader employment-based immigration matter.
Immigrant Petition
After completing the applicable Department of Labor step, the employer files Form I-140, Immigrant Petition for Alien Workers. The petition asks United States Citizenship and Immigration Services to classify the foreign worker in the appropriate immigrant category.
Visa Availability & Case Updates
Approval of the petition doesn’t complete the permanent residence process. Government processing and immigrant visa availability affect when the worker can proceed, and timing depends on factors outside the employer’s or worker’s control. We provide case-status updates throughout our representation so clients don’t have to interpret each development alone.
Permanent Residence Options for Eligible Family Members
An EB-3 case may also provide an immigration path for certain immediate family members. After the employer’s petition is approved, the principal worker’s spouse and unmarried children under age 21 may be eligible to apply for lawful permanent residence.
Eligible family members may apply with the principal worker or follow later. The proper filing path depends on the family’s circumstances, visa availability, and where each person completes the immigration process. We review this information as part of the broader case strategy.
