What Is An Immigration Hold?
An immigration hold, or detainers, are devices used by DHS or ICE officials when they believe a person who may be deportable has been arrested by a state or local law enforcement agency. The detainer instructs the local authorities to hold the arrested person for up to 48 hours beyond the time when he or she would be released. The arrested person might be released through posting bail, through charges being dropped, through serving out his or her jail sentence, or through being found innocent or guilty.
Detainers are not federal orders. They are requests issued to the arresting agency. The agency may or may not decide to honor them. The DHS or ICE officials should have reason or “probable cause” for issuing the detainer; they should not be random.
